    Terms of Service Agreements

    1. Purpose This agreement contains the entire understanding between the Photographer and the Client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties.

    2. Reservation Upon your signature, the Photographer will reserve the time and date agreed upon, and will not make other reservations for that time and date. For this reason, the Reservation Deposit is non-refundable, even if the date is changed or wedding cancelled for any reason, including acts of God, fire, strike, and extreme weather. The Reservation Deposit is to be paid at time of signing the contract and is applied towards the contracted Wedding Package. Client understands and agrees that the entire amount owed for the Wedding Package described in the contract is due on the Wedding Day, or on the Outstanding Balance Due date (if specified). If the balance is not paid by this time, the Photographer will not photograph the Wedding Day described in the contract, with a loss of Reservation Deposit by Client, and no liability to the Photographer.

    3. Pre-Event Consultation The parties agree to a pre-event consultation before the Wedding Day to finalize shooting times, locations, and the Client’s written request list for specific photographs. The Client is responsible for identifying desired individuals or designating someone to assist. The Photographer is not responsible for missed photographs if no one assists with identification or gathering. The Client agrees to set aside at least 30 minutes before the ceremony and 45 minutes afterward for photographs not obtained during the event. Late arrival of the bride or groom that prevents this window releases the Photographer from liability for missed photographs.

    4. Wedding Party Co-operation Both parties agree to cheerful co-operation and communication for best results. The Photographer is not responsible if key individuals fail to appear, fail to co-operate, or if images are missed due to undisclosed details. The Client is encouraged to designate an event guide to assist the Photographer in identifying important individuals.

    5. Shooting Time / Additions The photography schedule and methodology are designed to meet the Client’s goals and require punctuality and co-operation from all parties. Shooting begins at the agreed start time. Any additional photography or travel time requested beyond the agreed package will be billed at the Wedding Package rates, rounded to the nearest half hour.

    6. House Rules The Photographer is bound by the rules of ceremony officials and venue management. The Client agrees to accept the technical limitations imposed. Negotiation with officials is the Client’s responsibility, while the Photographer will offer technical recommendations only.

    7. Digital Negatives, Prints and Copyrights All photographs, digital negatives, and prints are protected by International Copyright Law, and the Photographer retains full copyright. If included in the Wedding Package, the Client may receive digital copies for personal use and sharing. Written permission from the Photographer is required for any commercial use or sale of the images.

    8. Model Release / Private Archive The Client grants the Photographer and assigns the irrevocable right to use and publish photographs of the Client and Guests for editorial, advertising, commercial, and any lawful purpose, in any medium, with the right to alter and copyright the images. The Client releases the Photographer from all claims and liability related to such use.

    9. Exclusivity / Guest Photography Formal photography time is reserved exclusively for the Photographer. Guest photography is not permitted during this time to avoid distractions. If time permits, guests may be allowed to take photographs; otherwise, guests are welcome to photograph freely during the rest of the wedding and reception.

    10. Co-operation of Guests and Other Service Providers The Client is responsible for guest conduct and coordination with other service providers. The photography schedule should be shared to prevent conflicts. Abusive behavior or interference with photography will not be tolerated. Damage to equipment or uncontrolled guest behavior may result in early departure of the Photographer with no refund.

    11. Completion Schedule No portion of the Event Package will be delivered until the Outstanding Balance is paid in full. Digital processing typically takes approximately two weeks, with prints and enlargements taking one to two additional weeks. A digital proof album will be provided within 30 days of the Event, assuming all balances and additions are paid.

    12. Payments The Reservation Deposit is due upon signing the contract, with the remaining balance due on the Wedding Day or specified due date. Event cancellation will be charged at 75% of the total contract price.

    13. Penalty Fees & Charges A $75 fee will be charged for any payment returned by the bank for any reason.

    14. Right of Withdrawal The Photographer may withdraw due to non-cooperation, changes in event details, missed appointments, or payment issues. If the Photographer withdraws, fees and deposits will be returned minus fair market value for services already rendered. Photography services are billed at $195 per hour and other services at $65 per hour, rounded up to the nearest half hour.

    15. Limit of Liability In the event of emergency or equipment failure, liability is limited to the return of payments received. The Photographer maintains professional-grade equipment and backups; however, loss or destruction of images limits liability to the amount paid. Partial loss is prorated based on the percentage of images lost.

    16. Non-Guarantee While every effort is made to capture all important moments, no unconditional guarantee is provided. The Photographer is not responsible for ruined images due to flashes, interference, or circumstances beyond control.

    17. Performance Performance of this contract is contingent upon acts of God, natural disasters, government regulations, electrical failures, strikes, or other conditions beyond the Photographer’s control.

    18. Severability If any provision of this agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

    19. Amendments This contract represents the entire agreement and may only be amended by written modifications signed and dated by both the Client and the Photographer.

    20. Reprint Orders Listed price for a 5x7 photo is $3.49 per print with a minimum order of 25 photos.
